How to check

Your tax bill names the county and state. A North Carolina case starts with a notice of hearing; a South Carolina case starts with a summons and complaint. If you are in North Carolina, this is the timeline.

Condos, townhomes and rentals

Fewer than half of Pineville’s homes are owner-occupied (48.9%, U.S. Census Bureau, 2020–2024), and a lot of what is owned is condos and townhomes. Both change how a foreclosure plays out.

Condo and townhome dues

An owners association can foreclose its lien through the Clerk once assessments are 90 days or more past due — for a few thousand dollars, on a home worth far more. Fines alone cannot be foreclosed that way. HOA and condo foreclosure in NC.

If you rent the house out

A landlord in foreclosure has the same options as any owner — reinstate, sell, short sale. But the tenants have rights of their own. A tenant with a genuine, arm’s-length lease is generally entitled to at least 90 days’ notice to vacate after a foreclosure, and can often stay to the end of the lease unless the buyer will live there.

That usually makes selling with the tenant in place easier than people expect, and it is worth telling your tenant early.

If you are the tenant

A foreclosure on your landlord does not end your lease overnight. Keep paying rent to whoever is legally owed it, keep your lease and receipts, and ask for any notice in writing.

Before the auction

A sale that closes first pays off the loan and any association lien. If you owe more than it is worth, a short sale instead.
